Mr. Penland is an active trial attorney who has handled hundreds of civil
litigation matters, including jury trials, bench trials, appeals, mediations,
arbitrations, and complex
negotiations since 1975. Mr. Penland has handled cases involving contracts,
divorce, child custody, abusive litigation, bankruptcy, software technology, internet law,
trademarks, copyright, intellectual property, and a large variety of other
matters.
Mr. Penland's special talent is in representing clients in matters involving
complex issues and high emotions between the parties, such as claims of abusive
litigation, divorces, and business disputes. He also represents peripheral
parties caught up in major business litigations. Mr. Penland has developed
effective procedures for managing cases having high volumes of documentary
evidence using case and document management software he has developed over the
years and that is customized to meet the needs of the individual case.
Mr. Penland has litigated and consulted on attorney fee issues at the trial and
appellate levels. Mr. Penland's practice includes representation of attorneys
and parties in attorney fee and abusive litigation matters, including O.C.G.A
Sections 13-6-11, 9-15-14, and 51-7-80.
Mr. Penland is a recognized speaker on the law and procedure of attorney fees in
Georgia. He has spoken for many years at the Georgia Institute of Continuing
Legal Education's annual Abusive Litigation seminar and at other seminars on
attorney fees.
Mr. Penland is a member of the Appellate Practice, Family Law, Intellectual
Property. and Technology Law sections of the State Bar of Georgia.

A primer on Georgia's application of the "American Rule" for charging attorney
fees against a party. O.C.G.A. § 13-6-11 is the default attorney fee rule in
Georgia civil cases and applies in all cases in which other, specialized rules
for attorney fees do not apply.
